The provider operates online under the name “Kunststudio Quartett.” All services offered under this brand are provided by KunstKita Quartett GmbH.
2. Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all contracts concluded via the website kunststudio.ch or directly with the provider concerning childcare as well as artistic courses (music, theater, painting, dance, etc.).
By making the booking, the customer agrees to these General Terms and Conditions. Deviating conditions from the customer shall only apply if they have been confirmed in writing.
3. Contracting Parties
The contracting parties of the provider are the adult parents or legal guardians of the registered child. They are liable for the fulfillment of all obligations arising from the contract, including payment and compliance with these General Terms and Conditions.
4. Services
The provider offers childcare services as well as artistic courses for children in accordance with the applicable course description on the website. The details in the respective course offer at the time of booking are decisive for the scope of services.
5. Registration and Contract Conclusion
Registration is done online via the website or in writing by email.
The contract is concluded upon the dispatch of the booking confirmation by the provider via email. The confirmation includes course details, price, and any additional conditions.
6. Prices and Payment
All prices are quoted in Swiss francs (CHF), unless otherwise indicated.
Payment is made using the payment methods offered on the website. Participation in the course generally requires full payment to be received before the start of the course. In case of delayed payment, the provider may reassign the place and claim damages for the delay.
7. Cancellation and Refund

The following cancellation conditions apply:
- More than 7 days before the course starts: full refund
- 4 to 7 days before the course start: 50% refund
- Less than 4 days before the start of the course: no refund
There is no entitlement to a refund for courses that have already started, including missed individual sessions. Clause 8 remains reserved.
8. Changes and Failures on the Part of the Provider
The provider reserves the right to reschedule or cancel courses for organizational reasons (in particular due to insufficient number of participants, illness, or the absence of the instructor).
In this case, an equivalent replacement appointment will be offered or the already paid course fee will be refunded on a pro-rata basis. Further claims are excluded, as far as legally permissible.
9. Force Majeure
In the event of force majeure (in particular official orders, pandemics, natural events), the provider is entitled to postpone courses, conduct them in an alternative form (e.g., online), or cancel them. In case of cancellation, payments already made will be refunded proportionally; further claims are excluded.
10. Duty of Supervision
During the scheduled course hours, the provider assumes supervisory responsibility for the registered children. Before and after the course hours, the supervisory responsibility lies with the parents or guardians.
The guardians are responsible for bringing and picking up the child on time as well as for correctly communicating relevant information (see section 11).
11. Health, Allergies, and Emergencies
The legal guardians are obliged to provide the provider with all health-related information relevant to the care before the start of the course, in particular allergies, chronic illnesses, regularly taken medications, as well as an emergency phone number.
If a child falls ill during the course or an accident occurs, the emergency contact number on file will be contacted immediately. In urgent cases, the provider is authorized to obtain medical assistance; the associated costs are borne by the legal guardians.
Sick children must not be brought to the class.
12. Liability
The provider is liable for damages resulting from the breach of its contractual obligations, including the duty of supervision, in accordance with legal provisions.
Liability for slight negligence regarding secondary obligations as well as for indirect damages and lost profits is excluded to the extent permitted by law. Liability for personal injury remains reserved in any case.
No liability will be assumed for personal items brought by the children (clothing, toys, electronic devices, etc.), except in cases of gross negligence by the provider.
13. Image and Sound Recordings
As part of the courses, photo or video recordings may be made, which can be used for documentation or advertising purposes (website, social media, printed materials). Publication will only occur with the express consent of the legal guardians, which can be revoked at any time with future effect.
Participants and accompanying persons are not permitted to make or distribute image or audio recordings of other children without the consent of the provider and the individuals concerned.
14. Data Protection

15. Copyright
All content on the website (texts, images, concepts, logos, teaching materials) is protected by copyright. Any use – including partial use – requires the prior written consent of the provider.
16. Applicable Law and Jurisdiction
Swiss law exclusively applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is Cham, Canton of Zug. Mandatory places of jurisdiction for consumer protection pursuant to Art. 32 ZPO remain reserved; in such cases, the consumer party has the choice of jurisdiction either at their place of residence or at the provider’s registered office.
17. Final Provisions
If individual provisions of these General Terms and Conditions are or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.
Changes to these terms and conditions will be announced on the website. For ongoing contracts, the terms and conditions valid at the time the contract was concluded shall apply.
